1. Overview and Contracting Entity

These Terms govern your use of the Arvelina website, online store and related services. Arvelina is a brand operated by OMNEXA LIMITED, a company registered in Hong Kong. “Arvelina”, “we”, “us” and “our” refer to OMNEXA LIMITED. When you place an order, your contract is with OMNEXA LIMITED.

Our store is powered by Shopify. By accessing the Services or purchasing from us, you agree to these Terms and the policies referenced in them. Nothing in these Terms limits mandatory consumer rights that cannot lawfully be excluded.

2. Eligibility and Accounts

You must be legally capable of entering into a binding contract. You must provide accurate, current and complete account, billing and delivery information and keep account credentials secure.

3. Products and Information

We make reasonable efforts to display product descriptions, sizes, materials, images and colours accurately. Actual appearance may vary because of screens, lighting, manufacturing batches or other reasonable factors. Product images are illustrative unless a characteristic is expressly guaranteed.

We may update descriptions, specifications, availability and purchase limits. This does not affect rights relating to defective, unsafe, damaged, materially misdescribed or non-conforming goods.

4. Orders and Acceptance

Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean acceptance. We may reject or cancel an order for genuine availability, pricing, payment, fraud-prevention, shipping or legal reasons. If we cancel after payment, we will refund the applicable amount.

Please review your order before submission. Once fulfilment begins, changes or cancellations may not be possible. Returns and refunds are governed by our Refund Policy.

5. Prices, Taxes and Payment

Prices and promotions may change without notice. Shipping charges, duties, taxes or import fees may be displayed separately at checkout or imposed by the destination jurisdiction. You confirm that you are authorised to use the submitted payment method. Payments may be processed by Shopify and other third-party payment providers.

6. Shipping and Delivery

Processing times, delivery estimates, destinations and charges are explained in our Shipping Policy and at checkout. Delivery dates are estimates unless expressly guaranteed. Customers must provide a complete and accurate delivery address.

7. Returns and Refunds

Eligibility, exclusions and procedures are set out in our Refund Policy. Contact support@arvelina.com before returning an item. Do not send returns to our registered address unless our support team expressly instructs you to do so.

8. Intellectual Property

The website and its content, including trademarks, branding, text, images, graphics, product descriptions and design, are owned by or licensed to OMNEXA LIMITED, Shopify or their respective licensors. You may not reproduce, distribute, scrape or commercially exploit protected content without permission.

9. Third-Party Services and Links

The Services may use third-party tools, payment solutions, applications or links governed by separate terms and privacy policies. We are not responsible for services outside our reasonable control.

10. Privacy

We process personal information as described in our Privacy Policy. Shopify, payment processors, logistics providers, analytics providers and other service providers may process information where necessary to provide the Services.

11. Reviews and User Content

If you submit reviews, photographs, feedback or other content, you confirm you have the right to provide it and grant us a non-exclusive, worldwide, royalty-free licence to use it for operating, improving and promoting the Services, subject to applicable law. Content must not be unlawful, misleading, defamatory, infringing or malicious.

12. Prohibited Uses

You must not use the Services for unlawful, fraudulent, abusive or infringing purposes; introduce malicious code; attempt unauthorised access; circumvent security controls; impersonate another person; or interfere with the website or other users.

13. Errors and Availability

We may correct genuine errors relating to descriptions, pricing, promotions, shipping or availability. If a material error affects an order, we may cancel it and issue an appropriate refund. We do not guarantee that the website will always be uninterrupted or error-free.

14. Disclaimers and Liability

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. Nothing excludes liability that cannot lawfully be excluded, including mandatory statutory consumer rights or liability for fraud.

Where permitted by law, OMNEXA LIMITED, Arvelina and our personnel will not be liable for indirect, incidental, special or consequential loss arising from use of the Services.

15. Termination

We may suspend or terminate access where reasonably necessary because of a material breach, suspected fraud, security risk, legal requirement or discontinuation of the Services. Rights and liabilities accrued before termination remain unaffected.

16. Severability and Waiver

If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue. Failure to enforce a right is not a waiver.

17. Governing Law and Jurisdiction

These Terms and contracts between you and OMNEXA LIMITED are governed by the laws of the Hong Kong Special Administrative Region, without prejudice to mandatory consumer protections applicable in your jurisdiction.

Subject to mandatory consumer jurisdiction rules, disputes shall be subject to the courts of the Hong Kong Special Administrative Region.

18. Changes to These Terms

We may update these Terms to reflect legal, operational, service or security changes. The current version and effective date will appear on this page.
